Parents Agree to Boys Chemo and Get Son Back

NEW ULM, Minn. — The parents of a Minnesota boy who refused chemotherapy for his cancer told a judge Tuesday they now agree to the medical treatment.

Judge John Rodenberg ruled Tuesday afternoon that 13-year-old Daniel Hauser’s parents could have custody of their son as long as they agree to treat his cancer with chemotherapy.

Brown County Family Services objected to the ruling, saying they wanted Daniel to remain in the custody of the county.

“I do not see why the court would consider a change in custody status,” said Tom Sinas, attorney for the guardian ad litem. “The only thing that has happened since we were last here is that Colleen Hauser fled the state with her son. I don’t see how that is the basis for revisiting the custody decision.”

Parents of the boy, Colleen and Anthony Hauser, say they understand now that their son needs chemotherapy. When Rodenberg asked Colleen if she believes chemotherapy is necessary to save her son’s life, she replied, “Yes I do.”

A recent exam showed a tumor in Daniel’s chest has grown — and is larger than it was when he was diagnosed in January, according to a medical report read in court by Rodenberg. The tumor is pushing against Daniel’s trachea, causing pain that Daniel rated as a 10 on a scale of one to 10.

“The doctor is stating in the strongest possible terms that this course of chemotherapy has to commence and commence soon,” Rodenberg said.

Daniel is scheduled for a round of chemotherapy on Thursday at a Children’s Hospital in Minnesota.

Daniel and his mother, Colleen Hauser, prompted a nationwide search when they fled for nearly a week after a court-ordered medical exam showed Daniel’s Hodgkin’s lymphoma had worsened. The boy and his mom arrived back in Minnesota around 3 a.m. Monday on a private plane.

Some Christians and others with faith have concerns about courts demanding individuals to provide undergo medical treatments that are  against their religious views.
